  8. License to Distribute or sell KittyHawk Software, Inc.ís "Paper Air 
  9. Force" Limited Version.

  11. This document (LICENSE.TXT) is the only terms in which we, KittyHawk 
  12. Software, Inc., ("KittyHawk") allow Commercial Distribution of "Paper 
  13. Air Force" Limited Version(the "Software").
  14.  
  15. To "commercially distribute" means to distribute for money or other 
  16. consideration.  It includes copying onto magnetic disks, CD-ROMs or any 
  17. other tangible medium now or subsequently known, and distribution by 
  18. retail rack, direct mail, catalog, advertisement, or trade show.  It 
  19. does not include distribution by any not for profit organization, by any 
  20. hobby, user or computer interest group to its members, or electronically 
  21. by any BBS or Internet site.

  23. "Paper Air Force" means version 1.0 and all of the related files 
  24. distributed by us under the mark "Paper Air Force."

  26. A. OWNERSHIP:  Except to the extent expressly licensed by us, we have 
  27. and reserve the exclusive copyright and other right, title and interest 
  28. to distribute the Program, and the right to use the Trademark in 
  29. connection with them.

  31. B. THINGS YOU MUST DO: You may Commercially Distribute the
  32. Program under this License so long as you:

  59. contractors, employees and agents harmless from damage, loss and expense

  61. and distributing the Software.  With respect to every matter arising 
  62. under this License, you consent to the exclusive jurisdiction and venue 
  63. of the state and federal courts sitting in Tucson, Arizona, USA, or as 
  64. otherwise permitted by law.

  73. FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE 
  74. ACCOMPANYING WRITTEN MATERIALS.  THIS LIMITED WARRANTY GIVES YOU 
  75. SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHERS, WHICH VARY FROM 
  76. STATE/JURISDICTION TO STATE/JURISDICTION.

  78. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL KITTYHAWK OR

  80. LIMITATION, PERSONAL INJURY, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  81. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY 
  82. LOSS) ARISING FROM THE USE OR THE INABILITY TO USE THIS KITTYHAWK 
  83. PRODUCT, EVEN IF KITTYHAWK HAS BEEN ADVISED OF THE POTENTIAL OF SUCH 
  84. DAMAGES.  BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION 
  85. OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE 
  86. LIMITATION MAY NOT APPLY TO YOU.
